One of our forumers sent TMNet an email regarding P2P throttling on Streamyx services, an issue we raised before.  Below is TMNet's reply, published verbatim. 

Thank you for your feedback. Our automated feedback system has forwarded your case to us for our attention and reply. Firstly, we would like to apologise for the late reply.

With regards to your issue, please be informed that prior to the remarkable rise of P2P traffic recently, it has indiscriminately pushed onto the maximum utilization of our network capacity, while on the other hand proven to be utilized by only 20% of our total user.

Due to this, currently, bandwidth are not equally distributed amongst DSL users upon file sharing applications and thus, resulting in a reduced performance in P2P applications.

Nevertheless, such exercise is not exceptional, as some other non-local service provider has already been doing this so as to manage the impact of P2P traffic on their network.

Regretfully, this approach can easily be positioned as unfavourable amongst our subscriber, and we're truly aware of this. While this is not a popular method of controlling Internet traffic, the fluctuation of the connectivity will be considered as best effort basis.

The problem may  surface and appear later depends on the condition of the NET. The feedback received from your good self is very significant for us to improve and again, this is actually how the service is wherever DSL technology is offered on the other side of the world.

As wat i know is the license for internet connection is limited thus those company who intend to apply for license is haunted with the terms and condition set by goverment.Well i have a terrible exprience in Alor Star,i try to upgrade my 512 plan to 1mb,guess i make a wrong selection to upgrade to 1mb coorparation plan which is charge me at rm1.5k for first month,tmnut keep on charging me with that plan even though they din't send anyone to setup for me,after first installation failed in fact i dint use the 1mb plan at all !!! i show up at tmnet centre they ask me to pay the amount they charge even though i dint use the service they provide!!!wtf is this???i admit mayb i make a wrong selection but the problem is they dint set up for me,i cant enjoy that service why i have to pay with bill???guess wat tmnut stuff told me? they said 'i pity u sir,but in this case u have to clear the amount due then i can only send your complaint to hq,they will investigate,and if the faulty is from our site we will pay u back' at that moment my heart shouted 'u thought i'm 3 years old huh?!'

I just downgraded my 1MB account to 512 b'coz I found out that even if you have subscribed for 1MB, they only restrict you to 512 speed! >:-(

well, TMNET SUCKS!!!!!!!!!!!!!! i'm living in Bintulu, Sarawak.. my streamyx is 1M, and u know what? normal download is 2kbps.. how come 1M go to 2k? they explain to me that is because of the cable they're using...

Why did they offer such a high speed service to us when they know they can't fulfill it? owh. did i mention the bittorent normal download is 1k -5k only?

From all the commente posted here, none of them mention anything about the right of subscriber! Do u know that TM actually commited fraud, if they know beforehead they cannot offer such services but still promote to customers? For instead, if they know in advance, from complaints or other means, the speed in certain areas could not be achieve, or as TM net put it- best effort, and TM still offer such speed to new customers.

For current situation, a better temporary solution is only limit(NOT BLOCK) bandwidth usage for heavy P2P at peak office and business hours. At night the ISP should release back those bandwidth back to P2P usage due to off peak or non-working hours.

For long term solution, the ISP have no choice should increase their facilities and infrastructure due to fulfill the P2P customer needs but then may be due to another FAIR use by each user policy then may be depends package such as 1Mbps package can have maximum(P2P) data usage such as 50GB but with fast speed such as 125KBps. At least we can finish our download within an hour or few hour. Then at least benefit for customer to save the electricity usage. Because of the slow downloading speed, no doubt sure a LOSE LOSE situation coz waste electricity, waste time and waste bandwidth(coz some ppl download half way then stop to continue due to slow or not connection at all!). So if a Quota limit BUT WITH Appropriate package speed (such as 100~125KBps for 1Mbps package) I believe also can be FAIR solution between ISP and User.

Hmm. Nice story but does not truly illustrate the p2p throttling. A more appropriate story would be like this:

100 people go to buffet lunch. 10% of the customers are fast eaters or heavy eaters and therefore eat up 90% of the food, leaving nothing left for the 90% small eaters. Basically everyone pays the same rate. So TM buffet is telling you, hey you can't eat so much although you paid for buffet. Its not all you can eat, its eat enough to share with others. laughing-smiley

This is SO WRONG! I have been to AUSTRALIA and what they do is allocate a fixed amount of bandwidth for the user say for example if u get package A, it comes with 20 gig of download quota and no throttling to any p2p software. This is fairer (my taught).
